Access to and use of this Website www.hoorayfortoys.co.uk and the sale and purchase of products from this Website are governed by the terms and conditions of use and the terms and conditions of business (together "terms and conditions") set out below.

By using this Website you agree to accept these terms and conditions. If you do not wish to accept these terms and conditions, please do not use this Website.

All contracts shall be governed by and construed in accordance with English Law and any dispute between us will be resolved exclusively in the courts of England and Wales. Nothing in these terms and conditions will be deemed to affect your statutory rights.

Orders

All goods available on our website are held in stock and orders are generally dispatched within 24 hours of ordering Monday – Friday excluding UK Bank Holidays. In the unlikely event that we are out of stock of an ordered item we will contact you within 24 hours and give you the option to either wait until the item is available from stock or receive a full refund within 7 days.

Prices, product descriptions and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions.

The price of the products is that displayed on the Website. The price is inclusive of UK VAT at 20%. We are also registered for French VAT (TVA) and customers in France will have the VAT charged at the French TVA rate of 19.6%. This will be amended from 20% to 19.6% during checkout. Customers outside of Europe eg USA and Canada are not charged any VAT and this element of the displayed price will be removed during checkout.

Payment for orders must be made in full before dispatch.

For the avoidance of doubt, receipt of an order does not constitute acceptance of an order.

We reserve the right to periodically update the prices on the Website, which cannot be guaranteed for any period of time. We will make every effort to ensure prices are correct at the point at which you place an order. In the event we have made an error in the displayed price we will contact you within 24 hours and advise you of the correct price. You will be given the option to cancel your order and receive a full refund or to proceed with your order at the correct price.

We reserve the right to withdraw any products from the Website at any time.

We shall not be liable to anyone for withdrawing any goods from the Website or for refusing to process an order.

Delivery

Our delivery partners are Royal Mail, Fedex and Parcelforce.

We offer several delivery options and these are clearly displayed in on our Delivery Info Page and during checkout. We dispatch our orders quickly but please note that delivery times are not guaranteed and we will not be held responsible for any losses, costs, damages or expenses incurred by you or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.

Delivery of your order shall be made to the delivery address specified on your order and you should make all arrangements necessary to take delivery your order whenever it is tendered for delivery.

Risk in the ordered goods shall pass to you upon delivery of your order.

If your order is returned to us due to the your failure to rearrange delivery or collection with the delivery provider (following attempted delivery), you may be liable to a further delivery charge to have your parcel delivered again.

Cancellation & Returns

You may cancel your order for any reason up to point of dispatch and we will refund any payments made in full within 14 days.

You may cancel your order for a period of 7 days after receiving your order and receive a refund (minus delivery charges) by emailing sales@hoorayfortoys.co.uk quoting your order number and your desire to cancel your order.

Cancelled orders must be returned at your expense within 7 days of cancellation in the original packaging, unused and suitable for resale. They should be adequately insured during the return journey. Following safe receipt of the goods, we will issue a refund of all monies paid for the returned goods excluding outward and return delivery charges.

If you are unable to return the order yourself and require us to collect it you will be charged the cost of us collecting the order by Parcelforce or Fedex.

Please contact us as soon as possible (and in any event within 7 days of receipt) if you receive a damaged or faulty item.

Faulty or damaged items must be returned to us within 14 days of receipt. Please contact us in advance of returning your order. On safe receipt of your returned item/s we will issue you either with a replacement or a full refund.

Privacy Policy

We take your privacy and security very seriously. We will only use your information for the purposes of fulfilling your order and, if you have agreed, to keep you informed of our Special Offers via our Mailing List.

Your details will only be forwarded to our payment and delivery partners for the purpose of fulfilling your order. They will not be passed to any other third parties unless we have your permission to do so or are required by law to do so.

Limitation of Liability

To the extent permitted by law, in the event of any breach of these Terms and Conditions by the Seller, the remedies of you the Buyer shall be limited to damages which shall in no circumstances exceed the price of the Goods and we, the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

Changes to Terms & Conditions

We, the Seller shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by you the Buyer upon making a purchase.
